How the EB-5 Program Works
The EB-5 program requires a minimum investment of $1,050,000 in a new commercial enterprise that creates at least 10 full-time jobs for U.S. workers. If the investment is in a Targeted Employment Area (TEA), which includes rural areas or zones with high unemployment, the minimum drops to $800,000. Many Miami-Dade County census tracts qualify as TEAs, making the lower threshold available for projects in areas you might not expect, including parts of downtown Miami and surrounding neighborhoods.
The investor receives a conditional green card for two years, then applies to remove conditions by demonstrating the investment was sustained and the jobs were created. After five years of permanent residency, the investor can apply for U.S. citizenship. The program includes the investor's spouse and unmarried children under 21.

Most EB-5 investors use a regional center, which is an approved entity that pools capital from multiple investors into large-scale projects. In Miami, regional center projects are often large condo developments, hotels, or mixed-use towers. The advantage is that the regional center handles job creation tracking and compliance, and the investor does not need to run a business.
