Rental and Dock Rules: UNIT LEASES Unit owners who purchased their units after March 19, 2009, may only lease their units if the lease of their unit will not bring the total number of leased units to more than twenty-seven (27) units. No unit may be leased during the first twelve (12) months of ownership.Leases must be. No leases will be considered for terms of less than three months or more than twelve months, and only two leases are permitted during a twelve-month period. Every lease must contain a provision against sub-leasing and pets.BOAT DOCK LEASES Residents desiring to rent a dock space must submit a request in writing to the Manager. Each December, the Board of Directors will decide whether dock spaces will be leased for the upcoming year by employing fixed-length, fixed-location spaces (numbered 1 through 10) or variable-length, variable-location spaces on a per linear foot basis. The Board will also decide in December whether to employ fixed prices by the fixed space or by the linear foot. Dock spaces are rented on a calendar year basis and all leases expire on December 31st of each year. A new lease is required every year. The Board of Directors and management will establish the dock rental rate each December with any change in the lease rate to be effective on the first day of the upcoming year. If space is available, a resident may lease as many as two contiguous fixed-length spaces or as much as 50 contiguous linear feet, as the case may be, but no boat at the EPT dock shall be in excess of 40 feet in length, in excess of 6 feet height from the waterline, in excess of 10 feet beam (width) or in excess of 12,000 pounds in weight. The Board of Directors must approve leases for dock space. For unit lessees, the dock lease will expire at the same time as the unit lease or on December 31st, whichever occurs first. The Association reserves the right to terminate any dock leases to a resident who refuses to comply with all provisions of the Boating Regulations.
